Panorama Panel Terms & Conditions

These Kantar Media Panorama Panel Terms and Conditions ("Terms") are entered into by Kantar Media Audiences Limited ("Kantar Media") and the household that accepts these terms ("you" or "Panelist"), including all members of the individual's household who are 2 years of age and over (note the measurement of individuals 2 to 15 years of age is undertaken for the explicit collection for the purposes of eliminating under 16 viewing data). You agree that you and your household's participation with the media and advertising engagement research project (the "Panorama Project" and related "Panel") that Kantar Media runs alongside the Association of National Advertisers ("ANA") are governed by these Terms. In these Terms the reference to "you" or "your" will mean all members of your household who are 2 years old and over, except where the context means only the individual signing these terms.

1. Accepting the Terms

1.1. Before participating in the panel, you will be asked to review and accept the separate Panorama Panel Privacy Policy ("Privacy Policy") which Privacy Policy governs both ANA and Kantar Media's ability to collect, store, use, and share the information obtained during your participation in the Panel.

1.2. In order to participate in the Panel, you must first agree to the Privacy Policy and these Terms. Your household may not participate in the Panel if you do not accept all the Terms and the Privacy Policy.

1.3. By continuing with your participation on the Panel, you are deemed to have accepted these Terms on behalf of all members of your household who are 2 years of age and over and will notify Kantar Media immediately if any member of your household subsequently rejects such Terms.

2. Your Participation in the Panel

2.1. You, and all members of your household who are 2 years of age and over, agree to carry out the following activities as a condition of your continued membership of the Panel:

2.1.1. To have a TV Meter (provided by Kantar Media) connected to each actively used TV set in your home and to indicate your presence in a room when a TV is switched on, via a remote handset (provided by Kantar Media) or via the meter touchscreen or the mobile app. Individuals under the age of 16 will be measured within the Panorama Panel with the explicit purpose of collection and subsequent removal of their viewing data from shared devices (including shared TV sets) in the interest of correctly attributing viewing to individuals 16 years of age and over only.

2.1.2. To have a Focal Meter (provided by Kantar Media) connected to the existing household broadband connection.

2.1.3. During your participation in the Panel, a number of ideas and/or materials may be presented to and/or discussed with you, including these Terms, which are private and confidential and not available to the public ('Confidential Information'). Your agreement to participate acknowledges that you must keep confidential any Confidential Information disclosed to you as part of Project Panorama or this Panel. This includes not sharing any Confidential Information with your family, friends, colleagues or others, and includes, but is not limited to, digital sharing on social media/networks, instant messaging etc.

2.2. You, and all members of your household who are 16 years of age and over, agree to carry out the following activities as a condition of your continued membership of the Panel:

2.2.1. To install metering software (provided by Kantar Media) on each compatible Panelist device (desktop, laptop, tablet, smartphone).

2.2.2. To agree to data exchanges with Google LLC, Meta Platforms, Inc (Facebook and Instagram) and other "online publishers" and their affiliates ("Exchange Data"). Kantar Media and ANA will only process Exchange Data if you provide your consent through the online portal that is made available to you.

3. Your Rewards

3.1. Upon acceptance of these Terms and the Privacy Policy, and completion of the installation process, a Panelist reward account will be provided for each Panelist Household to credit reward points for participation in the Panel for as long as you and all members of your household remain members of the Panel.

3.2. Points can be redeemed for rewards options including merchandise, travel, experiences, learning and charitable donations.

3.3. Rewards points and reward options are described in more detail on the rewards portal and are subject to change from time to time at Kantar Media's sole discretion without prior notice.

3.4. Reward points can be redeemed for reward options online using the rewards portal, details of which will be shared post-installation. Panelist reward account balances can also be checked online via the rewards portal.

3.5. Rewards are credited monthly for your continued participation in the Panel as set out in section 2. Bonus reward points are credited for reaching qualifying lengths of participation in the Panel. Reward points can also be awarded for completion of various other separate research tasks (such as questionnaire completion) offered to you and your household from time to time.

3.6. Reward points are issued at a rate of 10 reward points = $1, are not transferable and cannot be used for any purpose other than for redeeming reward options on this Panel.

3.7. Redemption orders will be sent to the Panelist primary address only (the ones registered with Kantar Media at that time) at Kantar Media's discretion. Upon termination of Panel membership, no further reward points will be credited after the termination date ("Panorama Membership Closure Date").

3.8. Upon termination of Panel membership, no further reward points will be credited after the termination date ("Panorama Membership Closure Date").

3.9. Upon termination of Panel membership, the Panelist reward account will be suspended immediately until such time as the TV Meters and Focal Meter ("the Meters") have been returned to Kantar Media. Kantar Media will provide return instructions and pre-pay the postal costs.

3.10. Upon receipt of the Meters the Panelist reward account will be re-activated so you can redeem any residual reward points until the Panelist reward account is terminated 90 days following the Panorama Membership Closure Date.

3.11. Kantar Media reserves the right to temporarily freeze Panelist reward accounts to cover extended periods where the Panelist cannot participate in the Panel, e.g. for extended holidays, sickness, moving residences, etc.

3.12. You and your household members agree to the redemption orders terms, the returns policy and other terms published on https://panoramapanel.elevate-awards.com. If you cease to agree to such terms you shall notify Kantar Media immediately.

3.13. Panelists may be eligible for a range of member benefits when certain qualifying lengths of Panel membership are reached. Full details are available on https://panoramapanel.elevate-awards.com or in the Panelist welcome pack and are subject to change from time to time at Kantar Media's sole discretion without prior notice.

3.14. In the event that you withdraw from the Panel, you agree to promptly return all Meters provided to you by Kantar Media. Upon your withdrawal, Kantar Media shall furnish you with detailed return instructions and a prepaid shipping label for the return of the Meters. You are required to return the Meters within 7 calendar days of receiving the shipping instructions and label. Failure to return the Meters within the specified time frame may result in Kantar Media seeking recovery of the replacement costs, attorneys fees and costs of collection for any unreturned Meters.

4. Miscellaneous

4.1. Except for the express warranties in these terms or the privacy policy, Kantar Media hereby disclaims all warranties, whether express, implied, statutory or other, under or in connection with these terms or the privacy policy.

4.2. Kantar Media shall not be liable to you (or to any person or entity claiming through you) for any special, incidental, indirect, consequential, exemplary, or punitive damages or any lost profits arising out of or in any manner connected with these terms, the privacy policy, or your participation in the panel, regardless of the form of action and whether or not Kantar Media has been informed of or otherwise might have anticipated the possibility of such damages. In no event shall Kantar Media's aggregate liability arising out of or relating to these terms, the privacy policy, or your participation in the panel exceed $100. The limitations of liability set forth in this Agreement shall not apply to any liability that cannot be limited by law.

4.3. The substantive laws of the State of New York shall govern these Terms as though these Terms were entered into, and were to be entirely performed within, the State of New York. All claims or disputes arising out of or in connection with these Terms shall be heard exclusively by any of the federal or state court(s) of competent jurisdiction located in New York County, New York. To that end, you irrevocably consent to the exclusive jurisdiction of, and venue in, such court(s), and waive any objection it may have to any proceedings brought in any such court.

4.4. (a) These Terms (i) may be modified or amended by Kantar Media at any time upon notice to you, (ii) may not be assigned by you without Kantar Media's prior written consent and (iii) along with the Privacy Policy, constitute the entire agreement between Kantar Media and you relating to the Panel. (b) If any of the provisions of these Terms are, to any extent, held to be invalid or unenforceable, the remainder of these Terms shall not be affected. (c) Nothing contained herein shall be construed as creating a partnership, joint venture or other contractual relationship between the parties.

Panorama Panel Privacy Policy

1. Introduction

This privacy policy (the "Policy") aims to provide you with information about the processing of your personal information in connection with the media and advertising engagement research project (the "Panorama Panel") that Kantar Media LLC, 600 Mamaroneck Avenue #400, Harrison, NY, 10528 Westchester County ("Kantar Media") runs in association with the Association of North American Advertisers ("ANA"). This Policy is provided for all participant panelists of the Panorama Panel, which includes participants who directly register on to the panel and other individuals of the household who participate.

Please read this Policy carefully.

For the purpose of this Policy, personal information means any information about an identified or identifiable individual.

2. Who We Are

Kantar Media is an independent data insight, research and brand consulting company and exists to provide information to its clients about population level trends in viewing, consumer choices and opinion research. Kantar Media administers the rewards program for your participation in the Panorama Panel. Kantar Media's website can be located at: www.kantarmedia.com

3. What is the Panorama Panel?

The Panorama Panel is an advertiser-led initiative. The ultimate aim of Panorama Panel is to create demographically representative reports which enable advertisers to better understand the advertisements which the US population have seen when viewing TV or browsing the internet / using apps across different devices (e.g. mobile phones and laptop computers).

This Policy describes the ways in which your personal information is processed to achieve this aim.

4. How to Contact Us?

Phone calls you make to Kantar Media panel support may be recorded and retained for 2 weeks for training and quality purposes.

6. Personal Information That Is Collected About You

a) "Survey Data" —Information about you and your household: As part of the initial recruitment interview and in follow-up telephone interviews, Kantar Media collects important contact information (such as your name, email, phone number and address), demographic information (such as age group, sex, household income, preferences and interests, the city, town or village you live in), and information about your Internet and TV services. This information is used to understand how different types of people consume different types of media and to make sure that the panel is representative of the US as a whole. Kantar Media may also collect your race and ethnic background for this purpose (see Section 6e).

b) "TV Data" —Information about your TV viewing: Kantar Media will ask you to install meters on all TV sets in your household. You will also receive a remote control that you should use to indicate who is watching TV. The meters collect a timestamp on a periodic basis which includes a record of the channel being watched, and who is watching TV.

c) "Internet Data" —Information about your use of the internet: Kantar Media will ask you to install a simple box (the Focal Meter) that connects directly to your broadband router and collects information about each of your Internet-connected devices. Kantar Media will also ask you to download a "Browser Meter" for PCs/laptops and a "Virtual Meter" for mobile devices. These record how frequently and for how long you engage with websites, platforms or applications from a predetermined list. Your other browsing data is not collected or retained.

d) Data Exchanges with Online Publishers: With your consent, we will share unique identifiers relating to you and your devices with Online Publishers in exchange for Exchange Data about what videos and ads you have seen, as well as demographic information. Kantar Media combines all data into pseudonymised profiles and models these to create demographically representative reports. End clients only receive aggregated reports and cannot identify you.

e) Sensitive data collection: Kantar Media may request your racial and ethnic background to ensure the panel is representative of the US. This is only used with your consent. There is no obligation to provide this information and it will not affect your participation.

f) Panel helpdesk data collection: If you contact our helpdesk, we will process the personal information that you provide to us in order to assist you with your request.

7. Data Disclosures

We may disclose or otherwise make available your Survey Data, TV Data and Exchange Data in the following ways: to Online Publishers (with your consent, unique identifiers will be shared); to Kantar Media Affiliates (for panel-recruitment purposes); to Service Providers (who perform certain services on our behalf); to Other Business Partners (for our own commercial purposes); in connection with a Business Transaction or Reorganization; to facilitate Legal Obligations and Rights; and with Your Consent or at Your Direction.

8. Accuracy

Kantar Media takes reasonable steps to keep your personal information accurate, complete, current and relevant. Kantar Media relies on you to help keep your personal information accurate, complete and current. If you need to update your personal information, please contact Kantar Media using the details at Section 4.

9. Children's Personal Information

Individuals under the age of 16 will be measured within the Panorama Panel with the explicit purpose of collection and subsequent removal of their viewing data from shared devices (including shared TV sets) in the interest of correctly attributing viewing to individuals 16 years of age and over only. Kantar Media won't collect data from children under the age of 16 for dedicated devices. In the case of shared devices, Kantar Media will collect viewing minutes and consumption habits of children aged 2 to 15 years for the purpose of identification and removal from data otherwise ascribed to consenting panelists 16 years of age and over.

10. Your Rights in Relation to Your Personal Information

Under certain circumstances, you may have rights under US privacy laws in relation to your personal information, depending on which state you reside in. To exercise your rights, please see Section 4.

We make the following rights available: Withdrawing your consent —you can withdraw consent at any time via the online portal or by contacting us. Opt-out of sale —you have the right to opt out of the sale of your personal information. Right to request access —you can receive a copy of your personal information. Right to request erasure —you can ask for your personal information to be erased in certain circumstances. Right to limit use of sensitive personal information. Right to request the transfer of your personal information to you or a third party.

11. Data Retention

Data collected will be retained for as long as reasonably necessary to fulfil the purposes it has been collected for. If you choose to leave the Panorama Panel, your personal information will be retained by us for no longer than 12 months to ensure that you can redeem your reward points.

Kantar Media may need to retain your personal information for a longer period for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. Personal information that is no longer required will be securely deleted or anonymized.

12. Changes to This Policy

We may update this Policy from time to time. When we make changes to this Policy, we will change the date at the beginning of this Policy. If we make material changes, we will notify individuals by email to their registered email address or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided.
